'Whereas, at the beginning of the conference call held on 23 November 2004 pursuant to Procedural Order No. 1, paragraph 10, the Respondents requested an extension of time of 4 months for the submission of their next brief, due by 21 February 2005 according to Procedural Order No. 1, paragraph 11;

Whereas, the Claimant opposed this request;

Whereas, the Arbitral Tribunal, after having heard the Parties on this question, and having taken note that they did not wish any further written exchange on the matter, informed the Parties that it would take a decision under the form of a Procedural Order;

Whereas, the conference call for the purpose established in paragraph 10 of Procedural Order No. 1 has therefore been postponed until 6 December 2004, at 6pm Paris time;

Whereas, the timetable established in Procedural Order No. 1 was discussed and decided during a conference call held on 27 May 2004 by the Arbitral Tribunal and the Parties;

Whereas, the Respondents made an express reservation, as indicated in the Minutes of said conference call, which states:

VII. General remark

As a general remark, counsel for Respondents mentioned that he was not in a position to confirm that the schedule was acceptable to his clients. The Arbitral Tribunal nevertheless adopted this schedule but mentioned that it could be modified for good cause shown.

Whereas, the Arbitral Tribunal has noted that the Respondents based their request for extension of time on their need to answer the technical expert report submitted by the Claimant with its Brief of 8 November 2004;

Whereas, the Respondents explained that the requested four months extension of time was essentially due to administrative reasons;

Whereas, according to the Arbitral Tribunal, this does not constitute a "good cause shown" that could justify such a long extension of time;

Whereas, the Arbitral Tribunal considers however that, under the circumstances described by the Respondents, it is reasonable to grant the Respondents-and therefore the Claimant-an extension of time of one month.

On the basis of the above the Arbitral Tribunal decides that

1. Paragraph 11 of Procedural Order No. 1 is modified as follows: "11. By 21 March 2005, the Parties will exchange their replies to their 8 November 2004 submissions".

2. The conference call provided for in paragraph 10 of Procedural Order No. 1 is postponed until 6 December 2004, at 6pm Paris time.'
